The carrier rejected your bus complaint: choosing the next independent review

After a carrier’s refusal, distinguish enforcement, ADR and an individual claim, find the competent body and prepare your bus case.

The carrier rejected your bus complaint: choosing the next independent review
Article contents

Your written complaint about a bus journey has been rejected, leaving your claim unresolved. It is tempting to forward the entire archive to every organisation with “transport” in its name. However, enforcing rules, helping settle a dispute and deciding a specific financial claim are not always the same procedure. The next step begins with choosing the right recipient.

AI-generated illustration: a passenger organises a bus complaint reply and documents for independent review

Below is a practical approach to finding a procedure, not a promise of success or universal legal advice. For international buses, the country, carrier, service type, subject of the dispute and applicant’s residence matter. The name of a European organisation does not by itself mean it will accept every case brought by a passenger from Ukraine.

Establish what has actually happened to your complaint

Open the latest reply and read it in full. Is it a final substantive rejection, an acknowledgement, a request for another document or a response from a different department? If support asks for a specific clarification, the next action may still be part of the initial review. Do not call a complaint rejected merely because the first message did not grant the amount you wanted.

Save your submission, proof of sending and the reply. For a website form, what matters is not just a screenshot of empty fields but the content actually submitted and the date. If there is no reply, check the official deadlines and procedure for your circumstances. Do not infer them from advice for another country or another mode of transport.

The Your Europe page on bus and coach passenger rights describes the complaints procedure and scope of EU rules. Check which provisions cover your connection. Do not apply all rights for a long-distance scheduled service to every bus service simply because it travels through Europe.

Define the aim of the next submission

Write the outcome you seek in one sentence. For example: investigating a possible breach of an information obligation; helping resolve a dispute about an undelivered service; considering a claim for specific expenses. These are different tasks. An enforcement body may have powers concerning compliance but not necessarily decide every individual monetary claim.

A seller’s refusal to explain a payment is not always a complaint about the actual transport. Check who is responsible for the disputed action: the sales agent, carrier, terminal operator or another service provider. Do not change the respondent merely because you found an easier form. The document should identify whose action you challenge and under which purchase.

Do not confuse three possible external routes

The first is the competent passenger-rights enforcement body. Its role depends on applicable rules and national powers. The second is out-of-court settlement of a consumer dispute, often called ADR. The third is a court or another statutory procedure for resolving an individual claim. Advisory services may also help find a route without themselves issuing a binding decision.

A useful example is the Italian transport regulator ART’s guidance. It distinguishes submissions for the exercise of supervisory powers from out-of-court settlement, which has a separate procedure. This illustrates different tools; it is not advice to send every international bus dispute to Italy.

When reading a description, find the sentence about its outcome: a decision, recommendation, settlement, compliance investigation or referral. This is more useful than a third-party promise to “recover your money through a European authority”. If the tool does not address your aim, numerous attachments will not remedy its lack of jurisdiction.

Finding the competent body rather than a similar name

Start with the official passenger-rights page and the national bodies listed there. For ADR, use the European Commission’s current consumer-redress overview and the particular organisation’s rules. Check the trader’s country, dispute subject, territorial scope and eligible applicants. Do not rely only on interface language or a convenient form.

If considering a European Consumer Centre, check eligibility based on your residence and the cross-border nature of the purchase. Holding a Ukrainian passport or a ticket to the EU does not by itself answer whether a particular application is admissible. Where the centre lacks competence, seek another appropriate mechanism rather than choosing a random country in the form.

Check admissibility before preparing a large archive

Make a short record of the procedure: who may apply, against which businesses, for which services, within what deadline, in which language and after which prior steps. Check whether a final carrier reply or expiry of a specified waiting period is required. If a rule depends on the type of claim, identify yours precisely rather than selecting the first available option.

Separately read restrictions on parallel or already completed proceedings. Do not conceal that the case has been submitted to another body or court. If unsure whether two routes can be combined, clarify this before filing, especially when a procedural deadline is approaching. Do not postpone necessary professional advice while waiting for an organisation whose competence has not been established.

Find out about possible fees, the legal effect of the result and whether the business must participate. “Out of court” does not automatically mean free or compulsory for every company. Do not pay a third-party intermediary simply to access an official form without verifying the resource and the service offered.

An old ODR link is not an active filing service

Older shop and carrier terms may still recommend submitting a case through the EU ODR platform. It closed on 20 July 2025, as stated in the official notice of ODR discontinuation. Do not waste time trying to register a new bus complaint through a tool that has already closed.

The platform’s closure does not mean all out-of-court bodies have disappeared. Find a current competent mechanism and its own procedure. If an old page redirects to an overview or directory, read the actual next step: visiting a directory is not filing a case. Do not hand your archive to someone offering to “restore an ODR account” for a fee.

Prepare the case so the next recipient can see the disagreement

On the first page, briefly describe the journey, disputed event, original complaint, reply and unresolved claim. Explain which part of the response you disagree with and the fact you rely on. Do not start another lengthy travel diary if the central issue is an overlooked document or a misidentified service.

Number attachments: the current ticket, relevant purchase condition, event notification, initial complaint, reply and evidence of specific expenses. Retain the currency and basis for each amount. Send copies using the prescribed method and keep originals. If providing an explanatory translation, do not change the facts and retain the original alongside it.

Protect other passengers’ unnecessary data. Do not publish passport pages, full bank details or QR codes in an open group for an initial enquiry. If the form requires authorisation to represent a relative, state your role truthfully and meet its requirements. Having a ticket in a family chat does not automatically establish authority to act for its holder.

After submission, track more than the “sent” status

Save acknowledgement, case number, date and the next expected action. If requested evidence is unavailable, explain that rather than creating your own proof. If the carrier offers a solution meanwhile, read its scope before accepting and notify the reviewing body of a material change. Do not claim money already received as still outstanding.

An illustrative passenger seeks reimbursement for a particular service not provided but receives only a general explanation that the bus reached its destination. In the next submission, they distinguish transportation from the paid option, attach the original response and verify the chosen body’s competence for that claim. They do not change the facts to “service cancelled” to access another procedure or assume success in advance.

    Checking sources and preparing documents

Official materials checked on 23 October 2026. Re-read the particular body’s current rules before filing: addresses, requirements and admissibility may change. For a concise account, see how to prepare a report about a disrupted bus journey. If a refund is already agreed but has not arrived, the starting situation is different: checking completion of a confirmed refund.

    Questions and answers

Will any enforcement body necessarily award me a refund?

No. Check its powers and the procedure’s intended outcome. Enforcing rules and resolving an individual monetary claim may involve different routes.

Can I complain to every organisation at once without mentioning the other cases?

Do not conceal previous or parallel proceedings. Admissibility may depend on them. Check compatibility before filing and report new decisions or payments.

The old terms contain an ODR link. Can I still submit a new complaint there?

No, the platform closed on 20 July 2025. Find a current competent body or another active mechanism using the official overview and its rules, not an outdated contractual clause.

Can a Ukrainian passenger always approach any ECC in Europe?

There is no such universal entitlement. Check the centre’s conditions, including the applicant’s and trader’s residence and the cross-border purchase. Do not enter an untrue address to get through the form.

Is attaching the latest rejection without my original complaint enough?

A clear case generally needs both: what you asked for and the response you received. Check the chosen procedure’s document list, add evidence of the earlier submission and explain the unresolved issue.
